II.1)		Description
II.1.1)		Title attributed to the contract by the contracting authority: Supply of electricity and provision of related advisory services for European Environment Agency offices.
II.1.2)		Type of contract and location of works, place of delivery or of performance: Supplies. Purchase. Main place of delivery: EEA offices: Kongens Nytorv 6, DK-1050 Copenhagen K, and Kongens Nytorv 28, DK-1050 Copenhagen K.

II.1.5)		Short description of the contract or purchase(s): The objective of this call for tenders is to establish a contract in accordance with the current legislation for the supply of electricity in the liberalised market and in accordance with the European Environment Agency’s environmental targets. The share of electricity from renewable energy sources has to be at least 40 % of the EEA’s total annual electricity consumption. The annual consumption of electricity is currently approx. 1 GWh.

II.2)		Quantity or scope of the contract
II.2.1)		Total quantity or scope: The annual consumption of electricity is currently approx. 1 GWh.
II.2.2)		Options: Yes. Description of these options: the duration of the contract shall not exceed 12 months. The contract shall be renewed by tacit agreement up to 3 times, each time for a period of 12 months, unless written notification to the contrary will be sent by 1 of the contracting parties. Number of possible renewals: 3.
II.3)		Duration of the contract or time-limit for completion: Duration: 48 months from the award of the contract.

III.1)		Conditions relating to the contract

III.1.3)		Legal form to be taken by the group of economic operators to whom the contract is to be awarded: Tenders may be submitted by groups of suppliers, that, if awarded the contract, shall assume a legal form by incorporation, partnership or will otherwise enable them to contract as a single entity. A group of suppliers, however, must identify the main contractor, the sole responsible towards the Agency, which will interface between the Agency and the supplier. Each member of the group must fulfil the conditions for participation mentioned in point III.2.

III.2)		Conditions for participation
III.2.1)		Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers: Information and formalities necessary for evaluating if requirements are met: Exclusion criteria — to be eligible for participation in this contract award procedure, tenderers must not be in any of the exclusion situations referred to in Articles 93 and 94 of Council Regulation (EC, Euratom) No 1605/2002 of 25.6.2002, OJ L 248 of 16.9.2002. To that effect tenderers are required to submit a declaration of honour in accordance with Article 134 of Commission Regulation (EC, Euratom) No 2342/2002 of 23.12.2002, OJ L 357/1 as last modified by Commission Regulation No 1248/2006 of 7.8.2006, OJ L 227. Under the same provision, the tenderer to whom the contract is to be awarded will be required to produce evidence confirming the prior declaration unless this obligation is waived by the contracting authority. Legal capacity — any tenderer will be asked to prove that he is authorised to perform the contract under national law, as evidenced by inclusion in a trade or professional register, or a sworn declaration or certificate, membership of a specific organisation, express authorisation, or entry in the VAT register.
III.2.2)		Economic and financial capacity: Information and formalities necessary for evaluating if requirements are met: proof of economic and financial capacity may be furnished by 1 or more of the following documents: a) certified true copies of the balance sheets and profit and loss statements for the past 3 financial years; b) bank statements attesting to the solvency of the company; c) statements of overall turnover or turnover for services performed over the past 3 financial years similar to those described in the invitation to tender.
III.2.3)		Technical capacity: Information and formalities necessary for evaluating if requirements are met: the evidence of the technical and professional capacity should be furnished on the basis of the following documents: (a) documents presenting the company and describing its activities; (b) a list of the major contracts performed during the past 3 years for services of similar complexity and size as those described in these tender specifications, with the sums, dates and recipients, public or private; (c) documentation of the capacity to cover at least 40 % of the Agency’s needs with renewable electricity; (d) documentation concerning the certification of the renewable electricity by an independent third party; (e) documentation of the last independent verification results; (f) documentation concerning provision of energy services and demand side management; (g) documentation regarding the existence of an independently verified internal environmental management system.
